1. Acceptance of Terms

By accessing or using CutelyAI ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

CutelyAI is an AI-powered portrait generation service that allows users to upload photos of their children, train a personalized AI model using LoRA fine-tuning technology, and generate artistic portrait images across a variety of themed settings.

The Service is provided on a credits-based system. Credits are consumed when training AI models and generating portrait images.

3. User Accounts

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

You must provide accurate and complete information when creating your account. You may not use a false identity or impersonate any other person.

4. Intellectual Property

Your Photos

You retain full ownership of the photos you upload to the Service. By uploading photos, you grant CutelyAI a limited, non-exclusive license to process those photos solely for the purpose of providing the Service to you.

Generated Images

You own the AI-generated portrait images produced from your uploaded photos. You may use, share, print, and distribute them for personal and commercial purposes.

CutelyAI Technology

The CutelyAI platform, software, brand, and underlying technology remain the exclusive property of CutelyAI. You may not copy, reverse engineer, or create derivative works from our platform.

5. Photos of Minors

The Service is designed for parents and legal guardians to create portraits of their own children. By uploading photos of a minor, you confirm that:

  • You are the parent or legal guardian of the child in the photos, or have explicit written consent from the parent or legal guardian.
  • You have the legal right to upload and process these photos.
  • You accept full responsibility for obtaining any necessary consents.

CutelyAI does not knowingly store photos of minors beyond what is necessary to provide the Service. Photos and trained AI models are deleted upon account deletion.

6. Prohibited Use

You agree not to use the Service to:

  • Upload photos of individuals without their consent (or parental consent for minors).
  • Create deepfake content intended to deceive or defraud.
  • Generate content that is illegal, harmful, or violates the rights of others.
  • Resell or redistribute the Service's capabilities without written permission.
  • Attempt to reverse engineer, scrape, or extract our AI models.
  • Upload content that violates any applicable laws or regulations.

7. Payment & Credits

The Service operates on a credits-based system. Credits are purchased through subscription plans or one-time top-ups. All payments are processed securely through Stripe.

Credits that have been consumed (used for training or generation) are non-refundable. Unused credits may be refunded within 14 days of purchase at our discretion. Subscription plans can be cancelled at any time; cancellation takes effect at the end of the current billing period.

8. Data Retention

Your uploaded photos, trained AI models, and generated images are stored securely on Cloudflare R2. Upon account deletion, all your data — including photos, AI models, and generated images — will be permanently deleted within 24 hours. We do not retain backups of deleted user data beyond this period.

9. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that generated images will meet your expectations. AI-generated content may vary in quality and likeness.

10. Limitation of Liability

To the fullest extent permitted by law, CutelyAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any claim shall not exceed the amount you paid us in the 30 days preceding the claim.

11. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by email or by posting a notice on the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.
